What obligations are at stake in the gender cases?  How will they
be enforced?  Against whom? 
Are the decisions in the gender cases just?  Are they law?  What
is the difference between legal and
moral obligation?  What is the source of legal obligation?
What rules are applied in the gender cases?  What do we mean by a
"rule"?

Dworkin, Ch. 1 (pp. 1-44)

Are the disagreements between majority/dissent empirical or
theoretical?  Are they disagreements
about what the law is, or what it should be?

Does the EP clause outlaw segregation?  Does it outlaw sex
discrimination?  On what issues do these
questions turn?
